SLIP/TRIP AND FALL CHECKLIST

  • STOP IMMEDIATELY. Do not change, alter or modify the condition or defect which caused the incident. The position, location and nature of the condition or defect will provide important information.

  • REMAIN CALM. Anxiety levels are usually high after an incident. However, it is necessary to keep your composure so you can make rational decisions and obtain the necessary and relevant information to protect your future interests.

  • REPORT. Report the incident to the proper individual and/or entity. For example, a homeowner, a store owner, a tenant, a superintendent, a supervisor, a store manager. Advise the proper individual and/or entity of how the incident occurred and the condition or defect that caused the incident. Do not engage in any other further discussions. It is imperative that a report be made documenting all the facts and circumstances surrounding the incident. Subsequently thereafter, obtain a copy of said incident report.

  • GATHER INFORMATION. Obtain as much information as possible. For example, the name and address of the premises, the store number,
    the supervisor/manager's name, the owner's name, the homeowners' name, the managing agent, the tenant's name, how long the condition or defect was present and who created the condition or defect.

  • WITNESSES. Obtain the names, addresses, phone numbers, and statements of any witnesses to the incident and/or of the condition or defect.

  • PHOTOGRAPHS. It is important to preserve evidence immediately after the incident. Take photographs of the condition or defect which caused the incident, as well as of the surrounding area in which the incident occurred. Moreover, take photographs of any injuries you sustained.

  • INJURIES. Call an ambulance and go to the Hospital. Even if it appears you are not injured, you should have medical personnel conduct a complete and thorough examination. If you are injured, see appropriate medical specialists for follow up care and treatment.
